Social Media Terms of Use｜Policies

KOKUYO CO., LTD. and its subsidiaries (hereinafter individually or collectively referred to as the "KOKUYO Group") hereby establish the following Social Media Terms of Use (hereinafter referred to as "these Terms") for the use of social media and accompanying services officially operated by the KOKUYO Group (hereinafter referred to as the "Services"). Please read these Terms carefully before using the Services.

1. Applicability of these Terms

(1) These Terms shall apply to all users who use the Services (hereinafter referred to as "Users").
(2) Notwithstanding the preceding paragraph, if the terms or policies posted by the KOKUYO Group in the account information, etc. of a Service account (hereinafter referred to as an "Official Account") differ from the contents of these Terms, the terms, etc. posted on each respective Official Account shall take precedence.
(3) “Official Accounts” refers to the accounts listed on the Official Accounts list page (https://kokuyo.life/en/sns/) and accounts where the KOKUYO Group has explicitly indicated that they are Official Accounts in the account information, etc. thereof (including the profile section).
(4) By viewing, following, or bookmarking an Official Account; liking or saving posts from an Official Account; reposting or retweeting; sending direct messages to an Official Account; posting content that includes hashtags related to an Official Account; or any other use of the Services by a User, the User shall be deemed to have agreed to these Terms.
(5) In addition to these Terms, the terms of use, guidelines, and other policies established by each social media platform shall apply to Users. Users shall comply with such terms of use, guidelines, and other policies.

2. Access to Basic Information

The KOKUYO Group may access publicly available account or profile information, such as the User's name, profile picture, gender, network, user ID, and friends list.

3. Regarding User Posts

(1) Copyrights and all other rights in the content of posts (including posts containing hashtags related to Official Accounts) made by Users in connection with Official Accounts (including any images, photos, videos, music, etc. posted, as well as the subjects, sound sources, and other components contained therein; hereinafter collectively referred to as "Post Content") shall be retained by the posting User. However, the KOKUYO Group shall be entitled to use, reproduce, distribute, publicly transmit, create derivative works of (including adaptation, translation, and curation), display, or otherwise utilize the Post Content in any manner, including utilizing it for the improvement, development, or application of KOKUYO Group products, on a worldwide, non-exclusive, royalty-free, and sublicensable basis, without obtaining further consent from the User.
(2) The license specified in the preceding paragraph shall include a license for other users to use the User's Post Content posted on the Services through retweeting, reposting, sharing, or any other method using features built into the respective social media platform. Furthermore, if the relevant social media platform features functions that allow other users to edit, delete, or otherwise modify Post Content, the User shall license such other users to modify their Post Content accordingly.
(3) The User agrees not to assert, and to ensure that any other rights holders do not assert, any moral rights of authors or performers against the KOKUYO Group and its successors and licensees.
(4) The User represents and warrants that the Post Content is lawful and does not infringe upon the copyrights, neighboring rights, portrait rights, publicity rights, honor, privacy, or any other rights of any third party. If any dispute arises with a third party in connection with the Post Content, the User shall resolve such dispute at their own sole responsibility and expense, and shall hold the KOKUYO Group completely harmless from any trouble, liability, or damage.

4. Regarding Posts by the KOKUYO Group

(1) Information posted by the KOKUYO Group on Official Accounts is protected by copyright laws, treaties, and other laws and regulations of each country.
(2) The KOKUYO Group prohibits Users from using, reproducing, distributing, publicly transmitting, creating derivative works of, displaying, or otherwise utilizing information posted on Official Accounts beyond the scope explicitly permitted by law, without prior consent from the KOKUYO Group.

5. Disclaimer

(1) The KOKUYO Group makes no warranties regarding the accuracy, currency, completeness, or legality of any information related to the Services, including any information posted on Official Accounts.
(2) The KOKUYO Group does not guarantee the continuous operation or availability of the Services. The KOKUYO Group may modify or terminate the Services, as well as the ability to post to Official Accounts, without prior notice.
(3) The KOKUYO Group shall not be liable for any damage incurred by Users arising out of the use of or inability to use the Services, except in cases where such damage is due to willful misconduct or gross negligence on the part of the KOKUYO Group.
(4) The KOKUYO Group shall not be liable for any trouble, disputes, or other issues arising between Users, or between Users and third parties, in connection with the use of the Services.
(5) The KOKUYO Group assumes no responsibility for any information (including comments, photos, and videos) provided by Users through their posts to Official Accounts. Such posts do not represent the official views of the KOKUYO Group.
(6) The KOKUYO Group shall not be liable for any loss of information provided by Users through posts to Official Accounts.
(7) The KOKUYO Group is under no obligation to respond to all posts, comments, messages, or direct messages (DMs) related to the Services.
(8) The KOKUYO Group does not follow back all Users who follow Official Accounts. Additionally, the KOKUYO Group may follow Users who do not follow Official Accounts.

6. Prohibited Matters

The KOKUYO Group prohibits the following posts and acts in connection with the use of the Services.

(1) Posting information that defames, slanders, or damages the reputation or credibility of the KOKUYO Group (which, for the purposes of this Article, shall include its officers and employees; the same shall apply hereinafter) or any third party, or their respective products or services, or any information that is likely to do so
(2) Posting information that causes, or is likely to cause, disadvantage, loss, or trouble to the KOKUYO Group or any third party
(3) Posting information containing false or misleading content
(4) Posting information containing violent or cruel expressions
(5) Posting information containing discriminatory expressions
(6) Posting information containing obscene expressions
(7) Posting information that is an obvious prank or lacks any linguistic meaning (including blank posts, meaningless character strings, repetitive posting of similar content, etc.)
(8) Posting information unrelated to the Services
(9) Posting content that impersonates any third party, including the KOKUYO Group
(10) Posting personal information (such as names, email addresses, physical addresses, or phone numbers) or other personally identifiable information
(11) Posting content related to commercial, political, or religious activities (including advertisements, promotions, solicitations, and links to other websites)
(12) Posting information containing anti-social expressions
(13) Acts that infringe, or are likely to infringe, upon the intellectual property rights, property rights, trade secrets, privacy, or other rights and interests of the KOKUYO Group or any third party
(14) Acts that damage or disable the systems of the KOKUYO Group or any social media service (including the distribution of harmful programs such as computer viruses)
(15) Criminal acts, acts that violate applicable laws and regulations, or acts that are likely to do so
(16) Acts against public order and morals, or acts that are likely to do so
(17) Any other acts deemed inappropriate by the KOKUYO Group

7. Violations of the Terms

(1) If a User violates any provision of these Terms, the KOKUYO Group may, without prior notice, block the User's account, delete or hide the Post Content, request the relevant social media service to delete the User's account, or take any other necessary measures.
(2) If the KOKUYO Group suffers damages due to any act of a User, the KOKUYO Group may claim compensation for such damages from the User.

8. Handling of Personal Information

When the KOKUYO Group obtains personal information from Users, it shall use and manage such information appropriately in accordance with the Privacy Policy established by the KOKUYO Group.

9. Amendments to these Terms

The KOKUYO Group may amend these Terms in any of the following cases by publishing the intent to amend, the amended terms, and the effective date thereof on the website of KOKUYO CO., LTD. (https://kokuyo.life/en/policies/sns/) or by notifying Users through other reasonable methods.

(1) When the amendments conform to the general interests of Users
(2) When the amendments do not contradict the purpose of transactions governed by these Terms and are reasonable in light of the necessity of the amendment, the appropriateness of the amended terms, and other circumstances surrounding the amendment

10. Governing Law and Jurisdiction

(1) These Terms shall be governed by the laws of Japan.
(2) Any and all disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.
